  • Completed work and deliverables remain property of client
  • No refunds for completed projects after 30 days

5. Intellectual Property Rights

Upon full payment, clients own all custom design work, content, and website code created specifically for their project.

  • Pre-existing tools, frameworks, and methodologies
  • General knowledge and techniques
  • Right to showcase work in our portfolio
  • Third-party software and plugins remain property of their respective owners

6. Project Timeline and Delivery

  • Standard projects launch within 7 business days
  • Complex projects may require extended timelines
  • Timeline delays due to client feedback or content delays are not covered by guarantees
  • We will communicate any potential delays promptly
  • Final delivery requires client approval and final payment

8. Limitation of Liability

ApexSites' total liability for any claims arising from our services shall not exceed the total amount paid by the client for the specific project. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

9. Termination

Either party may terminate services with written notice:

  • Client may cancel services with 30 days written notice
  • We may terminate services for non-payment or breach of terms
  • Upon termination, client retains rights to completed work
  • Outstanding payments remain due regardless of termination

10. Governing Law and Disputes

These terms are governed by the laws of the United States. Any disputes will be resolved through:

  • Direct negotiation between parties
  • Mediation if negotiation fails
  • Arbitration as a final resort
  • Legal proceedings in applicable jurisdiction
